A 4-year-old boy was injured in a San Francisco car accident, which police say, involved a hit-and-run driver. According to a Bay City News report, the pedestrian versus car accident occurred near the intersection of Capitol Avenue and Lobos Street in the Oceanview area, the evening of October 17, 2010. The young boy had exited a parked vehicle and was standing near the front of the car when another vehicle hit him. The driver failed to remain at the scene of the car accident. Police are searching for a burgundy 1980s-model four-door Honda that struck and injured the child. The hit-and-run suspect is described as a Latino man. The boy was hospitalized but thankfully sustained non-life threatening injuries.
I am relieved to hear the toddler was not fatally injured in this hit-and-run car accident. My thoughts and prayers are with him and his family while he recovers from his injuries.
Hit-And-Run Car Accidents
Leaving the scene of an injury accident or hit-and-run is a serious violation of California law. California Vehicle Code Section 20001 (a) states: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."
The report states that the hit-and-run driver in this case got out of his car, asked the boy's mother what happened and then drove away. What kind of a person would strike and injure a toddler and then leave the scene without offering any help to the mother. Apparently the boy's mother had to take her injured son to the hospital herself. This is a heartless, inhumane act. I sincerely hope the driver in this case is apprehended and brought to justice. Liability Issues
Victims of hit-and-run car accidents have the difficult task of working with their own insurance company to receive compensation for their losses. Anyone injured by a hit-and-run driver would be well-advised to seek the counsel of an experienced San Francisco personal injury lawyer, who will explain their legal rights and options. A knowledgeable car accident lawyer will also be able to advise victims or their families about how their car insurance policy might apply to a case where the hit-and-run driver is not identified or in a case where the at-fault driver is uninsured or underinsured.
