Two people who were killed in a car accident on the Interstate 8 in San Diego the morning of May 1, 2010, have been identified as Rebecca Evene O'Mara, 21, and Joshua Creston Carr, 25. 10news reports that O'Mara and Carr were traveling in a 2008 Honda Civic when their vehicle collided head-on with a Toyota Tundra driven by 25-year-old Adrian Villaneuva Jr. The fatal collision occurred near the intersection of Sunset Cliffs Boulevard when officials say one of the vehicles traveled the wrong way. Villaneuva sustained a broken wrist and collar bone in the crash and was taken to an area hospital. California Highway Patrol officials are investigating the crash.
My heart goes out to everyone who knew and loved Rebecca Evene O'Mara and Joshua Creston Carr for their terrible loss. They will be in my prayers.
Car Accident Causes
This news report leaves a number of questions unanswered. There are very few details in the report. The news article states police are testing Villaneuva to determine whether he was under the influence. Authorities have not yet determined which one of the drivers was traveling the wrong way at the time of the collision. It is also not known whether one of the drivers was fatigued or distracted at the time of the crash. I trust officials are examining these and other issues carefully in order to determine what occurred here and whether this was in fact a DUI collision.
Fault and Liability
If drugs or alcohol were involved, the negligent party could be criminally charged on suspicion of felony DUI and vehicular manslaughter. Driving under the influence is a serious crime in California. According to California Vehicle Code Section 23152 (a): "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.
A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a). An experienced California personal injury lawyer will stay on top of the official investigation and make sure that the victims' or their families' legal rights and best interests are preserved.
Other than the grief of losing a loved one, what do you think are the biggest challenges faced by families of deceased car accident victims, immediately after a crash?
