Sparky Wilber, 54, was killed in a Huntington Beach car accident after he lost control of his vehicle and crashed into a tree. According to a news report in the Huntington Beach Independent, Wilber was driving a 2007 Chevy Corvette along Indianapolis Avenue near Magnolia Street the night of March 27, 2010, when he apparently lost control of the car. Wilber was pronounced dead at the scene while his passenger was transported to a local hospital with injuries. Police say speed or alcohol may have been a factor, but an investigation is ongoing.

My heart goes out to the family and friends of Sparky Wilber for their tragic loss. Please keep this grieving family in your prayers. I also wish the injured victim the very best for a speedy and complete recovery.

Car Accidents

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were 12 deaths and 943 injuries involving car accidents in Huntington Beach. In Orange County as a whole152 fatalities and 13,414 injuries were reported as a result of car accidents in 2008.

Causes and Liability Issues

Based on this news report, officials are looking into speed and/or alcohol as possible causes in this particular accident. While it is possible that driver error or negligence caused or contributed to this crash, there may also be other factors in play. Was there a vehicle defect or a mechanical malfunction in the Corvette that caused Wilber to lose control? Was there a dangerous condition on the roadway, which caused the crash? Were there other vehicles involved? Was Wilber cut off by another vehicle or run off the roadway by another driver? I trust officials are looking at these and other factors in trying to determine how and why this tragic crash occurred.

If this car accident occurred due to a vehicle defect, the auto maker or the manufacturer of the defective product can be held liable. If a dangerous roadway condition caused this accident, the city or governmental agency responsible for maintaining this roadway could also be held responsible. Under California Government Code section 911.2, any claim against a governmental agency must be filed within six months of the accident or injury.
