Manslaughter Charges Filed in San Jose Car Accident

A 28-year-old bicyclist who died in a San Jose car accident the morning of February 1, 2010 has been identified as Joshua Ryan West. According to a news report in the San Jose Mercury News, the fatal bicycle accident occurred when the driver of a Chevy Blazer, 50-year-old Kevin Derr, lost control of his speeding car on Lark Avenue in Los Gatos. The SUV jumped the curb and struck West. Authorities say Derr was attempting to move ahead of slow-moving traffic and was traveling at a high rate of speed given the traffic conditions. He was apparently doing 50 in a 30-mph zone. Derr has been charged with vehicular manslaughter because authorities say they believe he was "grossly negligent" at the time of the collision.
