There were 268 deaths and 14,641 injuries in San Diego County as a result of car accidents, according to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS).
The question in this incident is: Was there any negligence on the part of the Humvee driver in this case? Was he or she impaired, negligent or driving recklessly at the time causing this serious accident? If that was the case the driver and his or her employer, the U.S. Government, could be held liable for Lewter's fatal injuries. If there was a dangerous condition on the roadway, the governmental agency responsible for maintaining that roadway could also be held liable for the accident. In California, any personal injury claim against a governmental agency must be filed within six months of the accident or injury.

Car accident victims or their families in such cases would be well-advised to consult with an experienced San Diego personal injury attorney who will make sure that a fair investigation is done, that the negligent parties are identified and held accountable. If there was negligence or wrongdoing involved, Lewter's family could file a wrongful death claim seeking compensation for funeral expenses, loss of wages, loss of love and companionship and other related damages.
