Officials in San Diego have indentified a motorcyclist who was killed in a San Diego car accident as Eric Sean Enockson. According to a news report in the San Diego Union-Tribune, Enockson's motorcycle was hit from behind by a driver on the Interstate 8. The driver, later identified as 27-year-old Claudia Herrera, did not stop at the scene of the accident. Instead she sped away in her Chevy Astro van dragging Enockson under the vehicle for quite a distance on the freeway. California Highway Patrol officials caught up with Herrera and arrested her. She has been charged with felony DUI, hit and-run and vehicular manslaughter.
I offer my deepest condolences to everybody who knew and loved Eric Sean Enockson. This victim's family and friends who must no doubt be grieving his tragic loss, will remain my prayers.
California Driving Laws
If the charges against her are true and are eventually proved in court, Herrera deserves what's coming to her. Both driving under the influence and hit-and-run are serious crimes in California. According to California Vehicle Code section 23152 (a), it is illegal to drive a motor vehicle under the influence of alcohol or drugs – recreational of prescription – and illegal to drive with a blood alcohol level of 0.08 percent or higher.
Also, California Vehicle Code section 20001 states: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."
An Experienced Personal Injury Attorney Can Help
Enockson's family would be well-served to contact a skilled personal injury attorney in San Diego who will follow up with the police investigation of this case and make sure their rights are protected. Where negligence or wrongdoing is involved, families of deceased car accident victims may be able to file a wrongful death claim to seek compensation to cover funeral or medical expenses, loss of earnings, loss of companionship and other related damages.
