A 7-year-old boy suffered major injuries in a Victorville car accident after he was struck by a car as he crossed the street. According to a news report in The San Bernardino County Sun, the major injury collision occurred the night of October 8, 2011, near the intersection of Village and Mojave drives. Officials say the boy and his older sibling were trying to cross Village eastbound when the accident occurred. The boy had stopped to pick up his skateboard and was behind his sibling when a Honda Civic hit him. The victim was transported to a local hospital with major injuries. Officials are investigating the cause of the collision. Alcohol is not believed to be a factor in the collision.
My heart goes out to the injured child and his family for what they are going through at this time. I wish him the very best for a quick and complete recovery. Please keep him in your thoughts and prayers.
Pedestrian Accident Statistics
According to California Highway Patrol's 2009 Statewide Integrated Traffic Records System (SWITRS), there were two fatalities and 18 injuries involving pedestrian accidents in Victorville. In San Bernardino County as a whole, 39 people died and 440 were injured due to pedestrian accidents, during the same year.
What Caused This Major Injury Crash?
Based on this news report, the boy was wearing dark clothing, which made him less visible. There are still several questions here. How fast was the driver of the Honda traveling at the time? Was he or she distracted or inattentive? Was there a dangerous condition on the roadway, which caused or contributed to this incident? I trust officials are examining these and other issues in order to determine what occurred here and why.
Liability Issues
If the motorist is determined to have been responsible for this accident, he or she could be held liable for the victim's injuries. A skilled San Bernardino personal injury lawyer will be able to determine whether a dangerous condition on the roadway may have caused or contributed to this incident. If that was the case, the city or governmental entity responsible for maintaining the roadway can also be held liable. Under California Government Code Section 911.2, any personal injury claim against a public entity must be filed within 180 days of the incident. The best personal injury law firms will always offer a free consultation and comprehensive case evaluation to injured victims and their families.
